Doubts have been raised over the implementation date of The Equality Act 2010 after the Government Equalities Office (GEO) removed the October 2010 date for implementation from its website. The Equality Act received Royal Assent on 8 April and the bulk of the legislation was due to be implemented in October. But the GEO's website no longer displays that date, and a fact sheet on the Act just states: "The provisions in the Equality Act will come into force at different times to allow time fo....

Something must be seriously wrong when a senior judge is advising people to keep as far away from the law as possible. The comments were made by Lord Justice Mummery in a Court of Appeal decision. He was considering whether to allow an appeal by a restaurant owner who had been ordered to pay £14,777 in compensation to a former employee for unfair dismissal and disability discrimination. The restaurant owner, David Piper, had attempted to lodge his notice of appeal with the Employment Appea....

There is an excellent article on the divorce Woolley & Co site, written by Andrew Woolley. He writes about the future landcape for law firms and observes that the opening of competion could have the following impact with the required response.  "This could lead to up to 70 per cent of law firms disappearing, based on the impact of past similar changes in the financial and insurance sectors. Firms need to be buying in expertise to help with things like business managemen....

The problems of "Bloodgate" at Harlequins Rugby Club illustrate the complelling need to settle cases. The problem facing all parties is that once a mediated settlement has not been reached your dirty laundering can be aired in public.  According to correspondence seen by Telegraph Sport, the player, Tom Williams made the request in a “final offer” sent to the club at 10.55am on Aug 7, the day of his deadline for appealing against the ban repr....

For those of you looking for some interesting reading with a law theme, please check out, Dele Ogun's book, The Law The Lawyers and The Lawless. I know Dele from Toastmasters(public speaking) and his book represents an intriguing autobiographical account from West Africa to the English Bar and provides an insight into  cultural integration to the UK. Dele is a genuine and skilful lawyer and good fun to public speak with as well.       ....

So we read in the Observer a pay freeze should be imposed on Britain's six million public-sector workers, the head of the government's spending watchdog says today. He also accuses party leaders of failing to be honest with the public about the need for cuts, even in health and education. We learn that , Steve Bundred, chief executive of the Audit Commission, says he has not heard any politician admit that "severe pay restraint" is one of a number of measures necess....

Any lawyer worth his or her salt will want to keep reading to quality material to stay up to date with developments in the law and beyond. Employers are being warned against rushing to axe staff in a misplaced bid for survival. According to employment relations service Acas, the percentage of calls to its helpline about redundancy rose from an average of 15% over 2008-2009 to 35% last February. This is my experience as well with many clients seeking redundancy advice. What are the alternatives to redundancy? One alternative is to change the terms and conditions of employment. The easiest way to do this is by getting agreement fr....

As was reported in the Law Society Gazette last month, "Proposals for a regulation regime for mediation faltered last week when mediators told the Civil Mediation Council (CMC) they need more time to consider ‘ambitious’ plans. However members of the organisation, which represents civil and commercial mediators, approved a scheme to register workplace mediators to meet the needs of the Department for Business, Enterprise and Regulatory Reform. The scheme will go live early in th....
